Terms and Conditions

The Hockey People EU
This contract is made under the following terms and conditions. Please read these terms and conditions carefully as they affect your rights and liabilities under the law.

Parties to the contract
The contract is between you (The Buyer) and The Hockey People EU (The Seller). The goods shall be the products supplied by the seller to the buyer according to these terms and conditions.

Order Acceptance
Orders placed by you are an offer to purchase and will be accepted by us, subject to stock availability. The contract of the sale of the goods will not be formed until delivery of the goods to you at the address that you give us. We retain the right to treat items ordered as separate orders. All orders placed on the The Hockey People EU Shop website will be confirmed at the time of purchase by email.

Payment
We will take payment from your credit card, debit card or PayPal account at the time you place your order. Taking payment does not mean we have accepted your order and, in the event of us not accepting your order, a full refund will be given as soon as reasonably possible (and in any event within 7 days of us advising you that your order has not been accepted).

Delivery

All orders within Europe will be shipped with DPD, and will take 3-10 days depending on the country. 
All orders outside of Europe will be shipped with PostNL or Fedex, depending on the service you choose the delivery time is approximately 10-20 working days. 
Any customs costs or VAT are the responsibility of the buyer.  

Returns
If you are not happy with your hockeypeopleeu.com purchase for any reason, please return the item, along with the details requested below, within 14 days of delivery. We will be happy to refund or exchange your items provided they are in perfect resalable condition in their original packaging.

We would like to draw your attention to the following:

we are unable to refund delivery charges unless the reason for return is due to a defect in the product
we are unable refund or exchange products which have been personalised
Please include the reason for your return, a copy of your receipt and whether you require a refund or exchange (please retain proof of posting from your shipper).

Stick Guarantee
At The Hockey People we take our commitment to supplying a quality product very seriously, to do this we will guarantee your stick for up to 30 days from the day of purchase against defective production. This means that in the event the stick develops a defect which is outside the normal wear and tear associated with stick use, we will repair or replace the stick. Examples of a broken stick are a stick that has broken into two or a head that has detached.

This does not include cosmetic issues or normal wear and tear, such as paint chips, grip, end cap, scratches or nicks, worn heel, loose material in the stick. The Hockey People will also not replace sticks that have been damaged due to front edge hitting as this is a skill illegal under the rules of hockey.

Hockey sticks are meant for playing hockey with and nothing else, they are not meant for hitting goal posts, sticks, benches, or unconventional playing surfaces. The Hockey People will not guarantee against damage coming from such misuse.

Please note that all stick replacement requests will be judged by our staff prior to being approved, if you feel that your stick has an issue please contact us in advance with a description of your stick issue and if possible photos so that we can swiftly resolve the situation.

Website
We endeavour to keep website up to date and error free. Occasionally, however, product description or pricing errors may occur. If we discover such an error after you have submitted an order to us, we will contact you prior to accepting your order with the correct details. You may then either cancel your order or re-confirm it based on the correct information. If we are unable to contact you, we will treat your order as cancelled.

Important Notice
While as above every care has been taken to describe items accurately, slight variations may occur with colour reproduction or text descriptions, to the extent permitted by law, we do not warrant that the text descriptions, colours or other content is accurate, complete, reliable, current or error free. Magellan Consulting Ltd shall not be liable for any indirect or consequential loss whether this arises from breach of duty, breach of contract, negligence or any other way. Liability for any claim shall not exceed the price of the goods supplied. Orders are for the personal, non- commercial use of our customer. All contracts are conducted in English and by entering into a contract both parties agree to submit to the sole jurisdiction of the courts, in accordance with EU law.

About our privacy policy

The Hockey People cares about your privacy. We therefore only process data that we need for (improving) our services and we handle the information we have collected about you and your use of our services. We never make your data available to third parties for commercial purposes. 
This privacy policy applies to the use of the website and the services provided by Hockey People EU. The starting date for the validity of these conditions is 8/07/2019, with the publication of a new version the validity of all previous versions is canceled. This Privacy Policy describes what information about you is collected by us, where this data is used for and with whom and under what conditions this data can possibly be shared with third parties. We also explain to you how we store your data and how we protect your data against misuse and what rights you have in relation to your personal information provided to us.

Webshop software

Bluepark
Our webshop has been developed with software from Bluepark. Personal data that you make available to us for the benefit of our services will be shared with this party. Bluepark has access to your data to provide us (technical) support, they will never use your data for any other purpose. 
Bluepark is obliged to take appropriate security measures based on the agreement we have made with them. These security measures consist of the application of SSL encryption and a strong password policy. Bluepark uses cookies to collect technical information regarding your use of the software, no personal data is collected and / or stored. 
Bluepark reserves the right to share collected data within its own concern in order to further improve the service.

E-mail and mailing lists

Bluepark
We send our e-mail newsletters with Bluepark. Bluepark will never use your name and e-mail address for its own purposes. At the bottom of every e-mail sent automatically via our website you will see the 'unsubscribe' link. You will then no longer receive our newsletter. Your personal data is stored securely by Bluepark. Bluepark uses cookies and other internet technologies that make it clear whether e-mails are opened and read. Bluepark reserves the right to use your data for the further improvement of the services and to share information with third parties.

Payment processors

Stripe / Paypal 
We use various platforms to handle (part of) the payments in our web shop. Stripe / Paypal. These payment providers process your name, address and residence details and your payment details such as your bank account or credit card number. All providers have taken appropriate technical and organizational measures to protect your personal data. The aforementioned payment providers reserve the right to use your data to further improve the service and to share (anonymised) data with third parties. All the above mentioned safeguards with regard to the protection of your personal data also apply to the parts of Stripe and Paypal's services for which they engage third parties. They do not save your data for longer than is permitted under the legal terms.

Shipping and logistics

DPD/POST NL/ 
If you place an order with us, it is our job to have your package delivered to you. We use the services of DPD/POSTNL to carry out the deliveries. It is therefore necessary that we share your name, address, residence details, telephone number and email with the courier company. The courier company will use this information only for the purpose of executing the agreement. In the event that the courier engages subcontractors, the courier will also provide your data to these parties.

Purpose of data processing

General purpose of the processing 
We only use your data for the benefit of our services. This means that the purpose of the processing is always directly related to the assignment you provide. We do not use your data for (targeted) marketing. If you share information with us and we use this information to contact you at a later date - other than at your request - we will ask you explicitly for this. Your information will not be shared with third parties, other than to comply with accounting and other administrative obligations. These third parties have all been sworn confidentiality on the basis of the agreement between them and us or an oath or legal obligation.

Automatically collected data

Data that is automatically collected by our website is processed with the aim of further improving our services. This information (eg your IP address, web browser and operating system) is not personal data.

Participation in tax and criminal investigation

In some cases, The Hockey People may be obliged to share your information in connection with government tax or criminal investigations on the basis of a legal obligation. In such a case, we are forced to share your data, but we will oppose this within the possibilities that the law offers us.

Your rights 
On the basis of the applicable Dutch and European legislation, you as a data subject have certain rights with regard to the personal data that are processed by or on behalf of us. We explain below which rights these are and how you can invoke these rights. 
In principle, in order to prevent abuse, we will send copies and copies of your data only to your already known e-mail address. In the event that you wish to receive the data at another e-mail address or for example by post, we will ask you to identify yourself. You can submit a request to that effect to our privacy contact person. You will receive a response to your request within 30 days. If your request is granted, we will send you a confirmation that the details have been changed on the e-mail address known to us.

Right to restriction of processing 
You always have the right to limit the data that we process or have related to your person or that can be traced back to you. You can submit a request to that effect to our privacy contact person. 
You will receive a response to your request within 30 days. If your request is granted, we will send you a confirmation to the e-mail address known to us that the data until you cancel the restriction will no longer be processed.

Right of transferability 
You always have the right to have the data that we process or have processed and that relate to your person or that can be traced back to you, performed by another party. You can submit a request to that effect to our privacy contact person. You will receive a response to your request within 30 days. If your request is granted, we will send you transcriptions or copies of all information about you that we have processed or that have been processed by us by other processors or third parties on the e-mail address known to us.
